Federal regulators drew a hard line in the highest-stakes US iGaming confrontation of the year. On 14 July 2026, the Commodity Futures Trading Commission (CFTC) ordered prediction-market exchange Kalshi to keep sports event contracts open for Michigan residents — openly defying a state-court ban and triggering a constitutional clash that legal experts say is headed for the US Supreme Court.

The standoff follows a 29 June 2026 temporary restraining order from Ingham County Circuit Court Judge Rosemarie E. Aquilina, issued at the request of Michigan Attorney General Dana Nessel and the Michigan Gaming Control Board. The court demanded Kalshi halt all sports event contracts in the state and unwind completed trades. Non-compliance after 12 August 2026 carries fines of $500,000 per day.


The Michigan Court Order

Michigan Attorney General Dana Nessel and the Michigan Gaming Control Board filed suit against Kalshi in March 2026, arguing the platform was bypassing state gaming law by classifying sports wagers as commodity futures contracts under CFTC jurisdiction. Judge Aquilina sided with the state on 29 June, issuing a temporary restraining order requiring Kalshi to cease offering, listing, matching, executing, clearing, and settling sports event contracts in Michigan. The court also demanded the platform unwind and refund trades already placed by Michigan residents — a directive that would collide directly with federal law.


CFTC Invokes Rare Emergency Powers

On 2 July 2026, Kalshi filed an emergency rule with the CFTC, proposing to force-liquidate the specific Michigan contracts and absorb resulting losses from its own operational funds. The CFTC rejected that approach and on 14 July invoked emergency authority not deployed since President Jimmy Carter’s 1980 grain embargo against the Soviet Union, directing Kalshi to settle all outstanding Michigan trades through normal procedures. CFTC Chairman Michael S. Selig warned that reversing executed trades would create an “unprecedented step that risks a cascading effect on the entire marketplace and undermines certainty in contracting.”


Kalshi’s Impossible Position

With a state court ordering trade cancellations and a federal regulator ordering trade fulfillment, Kalshi’s Head of Enforcement Robert J. Denault described the company as facing an “impossible position.” Kalshi had already partially unwound some contracts to comply with Judge Aquilina’s order before the CFTC intervened, leaving some Michigan traders in legal limbo. The CFTC countered that permitting reversal of executed trades would “risk shattering public confidence by giving traders cause to worry that the trades they execute today may be unwound a week — or a year — later.” Michigan’s $500,000-per-day fine clock starts on 13 August if geofencing is not in place.


The Enormous Kalshi Prediction Markets at Stake

The regulatory battle is playing out against explosive growth. Kalshi raised $1 billion at a $22 billion valuation in May 2026, then posted $31 billion in total notional trading volume in June — a 70% jump from May — with sports contracts accounting for roughly 85% of all activity. The platform recorded more than $344 million traded on the 2026 World Cup alone. With sports prediction markets now rivalling traditional licensed sportsbooks in scale, the outcome of this federal-state fight carries billion-dollar consequences for every operator and bettor in the country.


A Nine-State Federal Showdown

Michigan is not an isolated case. The CFTC has filed suit against nine statesArizona, Connecticut, Illinois, Kentucky, Minnesota, New Mexico, New York, Rhode Island, and Wisconsin — to establish that federally regulated prediction-market exchanges sit beyond the reach of state gambling enforcement. In Arizona, a federal court permanently blocked the state from pursuing criminal charges against Kalshi, though appeals remain pending. In New York, Kalshi lost a bid for a preliminary injunction, leaving that state’s enforcement efforts alive. Legal experts broadly expect the jurisdictional conflict to reach the US Supreme Court within one to two years.
